These terms govern your use of the Poolside Progress app ("the app"). By creating an
account or using the app you agree to them. The app is provided by
Rob Callaghan (sole trader), trading as Poolside Progress ("we",
"us").
1. Who can use Poolside Progress
At sign-up you choose whether you are a parent/guardian or the swimmer.
A parent/guardian must be 18 or over; they hold the account and add their swimmer(s).
A swimmer aged 13 or over may hold their own account.
An under-13 swimmer cannot create or hold their own account in this version;
a parent/guardian can add them as a swimmer under the parent account.
A parent and their 13+ child can each hold the same swimmer.
By adding a swimmer you confirm you are entitled to manage that swimmer's data.
2. What the app does
Poolside Progress shows your own swimmer's times, personal bests, qualifying-time gaps, progress over
time, and gala-day race information. It is an information and benchmarking tool for parents,
guardians and swimmers.
3. Data sources and accuracy
Your swimmer's results are based on publicly available competition results and are provided
for information only. Poolside Progress is an independent app and is not affiliated with,
endorsed by, or an official service of any swimming governing body or association.
Qualifying times are based on published county/regional standards and may change; always
check the official source before relying on a qualifying decision.
Times, gaps, predictions and gala information are provided for guidance only
and may contain errors. Do not rely on them for entries, eligibility or any competitive
decision without confirming against official sources.
4. Acceptable use
You agree not to:
use the app to build profiles of, track, or target other people's children;
attempt to extract data about swimmers other than your own;
misuse, reverse engineer, or disrupt the app or its infrastructure;
use the app for any unlawful purpose.
5. Your account
You are responsible for keeping your login secure. You can delete your account and all linked
data at any time in Settings → Account → Delete account & all data. We may
suspend or remove accounts that breach these terms or applicable law.
6. Privacy
Our handling of personal data is described in the Privacy Policy,
which forms part of these terms.
7. Availability and changes
The app is provided on an "as is" and "as available" basis. We
may change, suspend or withdraw features, and may update these terms; continued use after a change
means you accept the updated terms.
8. Liability
To the extent permitted by law, we are not liable for losses arising from reliance on
information in the app (including times, gaps and gala data), or from interruptions to the service.
Nothing in these terms limits liability that cannot be limited by law.
9. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales
have exclusive jurisdiction.
